Full title and description

Technical Regulation of the Eurasian Economic Union (EAEU) TR EAEU 040/2016 — "On the safety of fish and fish products". Establishes mandatory safety requirements for fish and fishery products (including aquaculture products), and for related processes of production, packaging, storage, transportation, distribution, sale and disposal, together with labeling and packaging requirements intended to protect human and animal health, property and the environment and to prevent misleading of consumers.

Abstract

TR EAEU 040/2016 sets product, process and documentary requirements for fish, seafood, caviar, seaweed and derived products placed on the market within EAEU member states. The regulation defines microbiological and residue limits, permitted/forbidden additives for specific categories (including stricter rules for infant products), rules for production-premises registration, sampling and testing, conformity assessment routes and marking with the EAC conformity mark to enable free circulation in the Union while protecting public and animal health.

General information

  • Status: In force (effective), with a specified delayed application for certain veterinary-residue control provisions (Clause 15).
  • Publication date: Adopted by Decision No. 162 of the Eurasian Economic Commission on 18 October 2016; entered into force on 1 September 2017 (with exceptions noted above).
  • Publisher: Eurasian Economic Commission (EEC) on behalf of the Eurasian Economic Union (EAEU).
  • ICS / categories: Food technology — Fish and fishery products (ICS 67.120.30).
  • Edition / version: TR EAEU 040/2016 (original regulatory act adopted 2016; implemented 2017).
  • Number of pages: Approx. 140 pages (full text including annexes in typical published versions).

Scope

The regulation applies to food fish products placed into circulation on the territory of the EAEU, including live fish and live aquatic invertebrates; fresh, chilled, frozen, pasteurized, dried, salted, smoked and otherwise processed fish and aquatic products; canned products, caviar and roe; fish oils and other products of aquatic origin; imitation fish products; semi-finished products and baby foods derived from fish. It covers production, processing, packaging, storage, transportation, distribution, sale, labeling and disposal. Certain processes (e.g., breeding/rearing, non-commercial household products) and non-food products are excluded; implementation of veterinary-residue provisions was deferred pending development of testing/sampling interstate standards.

Key topics and requirements

  • Mandatory product-safety requirements for fish and fishery products (microbiological, chemical and physical safety limits and indicators).
  • Rules on veterinary drug and contaminant residues in aquaculture products, with phased application pending harmonized testing/sampling standards.
  • Prohibitions and limits for certain additives and processing aids (special restrictions for infant and young-child fish foods).
  • Requirements for production-premises registration, hygiene and process controls across production, storage and transport stages.
  • Conformity assessment schemes (declarative and certification procedures), required documentation and registration of declarations; rules for use and placement of the EAC conformity mark.
  • Labeling, packaging and traceability requirements to prevent consumer deception and to ensure identification throughout product life-cycle.
  • Testing, sampling and analytical method requirements (with references to interstate standards and accredited laboratories for test protocols).

Typical use and users

Manufacturers, processors and packers of fish and seafood; aquaculture operators; importers and exporters to/from EAEU member states; distributors, wholesalers and retailers; conformity assessment bodies and testing laboratories; national competent authorities responsible for food safety, veterinary control and market surveillance within EAEU member states. The regulation is used to prepare technical documentation, implement HACCP/food-safety measures, obtain declarations/certificates and ensure correct labeling and traceability.

FAQ

Q: What is this standard?

A: TR EAEU 040/2016 is a binding technical regulation of the Eurasian Economic Union that establishes safety, labeling and process requirements for fish and fish products marketed within EAEU member states.

Q: What does it cover?

A: It covers a wide range of fish and seafood products (live, fresh, chilled, frozen, processed, canned, smoked, caviar, oils, seaweed, etc.), and sets requirements for production, storage, transport, packaging, labeling, testing, permissible limits (microbiological, chemical, residues) and conformity assessment. Certain veterinary-residue provisions were deferred until related interstate testing standards are adopted.

Q: Who typically uses it?

A: Producers, importers, exporters, certification bodies, testing laboratories and national food-safety regulators operating in or trading with the EAEU market use the regulation to demonstrate and verify conformity and to ensure market access.

Q: Is it current or superseded?

A: The regulation was adopted in 2016 and entered into force on 1 September 2017; it is active (in force). Some specific provisions (notably Clause 15 on residue control) required later implementing interstate standards before full application. Users should check for any later amendments or related EAEU decisions when preparing compliance documentation.

Q: Is it part of a series?

A: Yes — it is one of the EAEU technical regulations addressing food safety and product safety within the Union and is used alongside other EAEU/CU technical regulations (e.g., TR CU 021/2011 on food safety, TR CU 022/2011 on labeling, TR CU 005/2011 on packaging).

Q: What are the key keywords?

A: Fish safety, seafood, aquaculture, EAEU, conformity assessment, EAC mark, veterinary residues, microbiological standards, labeling, packaging, sampling and testing.
